The Black Redstart (Phoenicurus ochruros) are found on brownfield sites and can be mitigated for in development. It is a schedule 1 bird.

Most British wild bird species, their nests and eggs are protected under the Wildlife and Countryside Act 1981, and there are a number of species that are given special protection under Scedule 1 of The Act. For example, the black redstart and barn owl are protected from disturbance while nesting or having dependant young.

The presence of even common, widespread and abundant nesting species can thus impose seasonal constraints on pre-construction site clearance of trees and scrub or other nesting habitat.
